Google sued by an Insurance company

According to the latest reports one of the American insurance companies has charges a case against Google for following a deceptive trade practice for showing links of unflattering posts in the search results. The court papers filed in Alabama says that one of the India based subsidiary of Torch Corporation, American Income Life Insurance claims that Google is showing some negative results from scam.com and pissedconsumer.com in its search results. The Google result pages displays snippets of the results like "American Income Life is a Scam," these results break the Alabama business laws

The 9th Circuit Court of Appeals and many others said that Google was immune from liability for a bad review, which appeared on Places and was authored by an anonymous user.

which are related to unconscionable, false, misleading or deceptive acts or practices, says American Income life. According to the lawsuit, which was filed in state court in September and transferred to federal court in Alabama last week, American Income Life Insurance is not any sort of faked or scam infact it is respectable business corporation which has been serving public since many years.

Before filing the case American Income life Insurance also proposed Google that the irritating results could be deleted or shifted to some less visible page, all this was proposed in a letter written by attorney William Baxley who wrote in a May 12 letter to Google's chief legal officer David Drummond. On this letter Google responded by saying that they won't be able take any against this and removing any content from its place won't be possible. Baxley's law firm then sent a second letter to Google complaining about the search results.

The Google Team reacted to the letter by saying that the company was protected from offense lawsuits under Section 230 of the Communications Decency Act. Numerous other courts have agreed with Google on that point. Most recently, the 9th Circuit Court of Appeals said that Google was immune from liability for a bad review, which appeared on Places and was authored by an anonymous user.
